Project 100 leases the building for use as a Gallery at 100 Collingwood Street, Whakatu Nelson.

By accepting the terms and conditions set out below, the Artist/s (the Licencee) wishes to occupy Project 100’S Gallery.

1. Grant and Duration of Licence

1.1 The Artist/s shall pay a total fee for a one month period of $1200.00 to Project 100 (the Licence Fee).This includes a bond of $400 which will be returned at end of lease if building and grounds are left in good order.

1.2 In consideration of the Gallery Fee, Project 100, on acceptance of your booking grants the Artist/s an exclusive right to use, enjoyment and occupation of the Gallery subject to the terms of this agreement.

1.3 This agreement shall commence on the beginning of the month that is reserved and shall end at the end of that month unless otherwise specified.

2. Licensee’s Obligations

2.1 The Artist/s agrees that they shall pay any of their expenses in respect of the the Artist/s use of the Studio.

2.2 The Artist/s shall use the Studio for an art gallery space and related/similar activities only and agrees not to sleep in the gallery or in the carparks outside nor use the space for parties.

2.3 The Artist/s agrees that they won’t offer the gallery space to any other party during their booking.

2.4 The Artist/s, are responsible for insurance of their personal belongings and art works including domestic contents kept at Project 100

2.5 The Artist/s shall ensure that the Project 100 Gallery is kept in good condition. The Artist/s is responsible for internal maintenance and care of chattels within the gallery space and the outside area relating to the space, while occupying the property for their month. This may include sweeping of leaves , removal of rubbish, cleaning windows and so on.

2.6 The Artist/s agrees to leave walls, windows and floors clean, in and outside as found and if Project 100 isn’t happy with it then the Artist/s shall reimburse them for costs of cleaning and remediation of the studio and will not get their $400 bond back.

2.7 The Artist/s agrees that if the walls are penetrated and/or damaged from the purposes of hanging art, they shall ensure the walls are filled and painted to gallery standards before their departure.

2.8 The Artist/s agrees to comply with all local Council authority rules and regulations with regard to the use of the premises and business activities. Like noise and alcohol etc.

2.9 The Artist/s will comply with all health and safety regulations while on the site.

2.10 If having an exhibition opening The Artist/s must always provide food with alcohol (wine or beer is okay but no spirits allowed).

2.11 The Artist has an obligation to make the exhibition accessible to the local community by opening the gallery space for a minimum of 20 hours per week during their occupancy. We prefer Artists to open the space from 10am - 3pm (Wednesday - Saturday), however if this is not possible for you please get in touch directly. Volunteers can be arranged to cover some of these hours.

3. Project 100’s Obligations

3.1 Project 100 holds insurance over the building (but the artist must agree not to intentionally engage in activities that may cause damage to the building.)

3.2 Project 100 agrees not to unreasonably interfere with the Artists quiet enjoyment of the premises.

4. Rights of Entry to the Gallery

4.1 Project 100 staff (or their agent) shall enter the Studio only:

(a) With the tenant’s consent at the time of entry;

(b) In an emergency or to undertake emergency repairs to the property;

(d) For the purpose of complying with any obligation as contemplated by this Deed by the giving of no less than 24 hours written notice to the Licensee;

(e) For an inspection of the Studio (Routine Inspection) by the giving of no less than 12 hours written notice to the Artist; and

(f) For the purpose of ascertaining the Artist’s compliance of any obligation as contemplated by this Licence following notice from Project 100 to the Artist to remedy a breach.

5. General

5.1 The Artist agrees to use the Studio at their own risk and releases to the full extent permitted at law Project 100 and their agents and/or employees) from all claims and demands of any kind and from all liability which may arise in respect of any accident, damage, or injury occurring to any person in or about the Gallery.

5.2 The Parties acknowledge and agree that the rights afforded to the Artist in accordance with this Licence are personal to the Artist and shall continue for so long as they shall require it as contemplated by this Licence.
